Fresh FIR Filed Against Rahul Gandhi, Sonia Gandhi in National Herald Case

New Delhi : A fresh round of legal trouble has emerged for senior Congress leaders Sonia Gandhi and Rahul Gandhi, with the Delhi Police’s Economic Offences Wing (EOW) registering a new First Information Report (FIR) against them in connection with the long‑running National Herald case. The FIR, filed on October 3, follows a complaint forwarded by the Enforcement Directorate (ED) and adds new layers to a controversy that has persisted for over a decade.

The case revolves around allegations that the Gandhis and several associates engaged in a criminal conspiracy to fraudulently acquire Associated Journals Limited (AJL)—the company that once published the National Herald newspaper—through a private entity called Young Indian. According to the FIR, AJL owned properties valued at more than ₹2,000 crore, which were allegedly taken over for a nominal sum of ₹50 lakh.

What the Fresh FIR Alleges
The new FIR names Sonia Gandhi, Rahul Gandhi, Sam Pitroda, Suman Dubey, Sunil Bhandari, and three companies—Young Indian, Dotex Merchandise Pvt. Ltd., and AJL—as accused parties. The ED’s complaint alleges that government‑allotted properties originally given to AJL at concessional rates for public welfare activities were diverted for personal or organizational gain.

The FIR invokes sections of the Indian Penal Code related to cheating, criminal conspiracy, and criminal breach of trust, suggesting that the takeover of AJL was not merely a financial restructuring but a deliberate attempt to gain control of valuable real estate assets.

Background of the National Herald Case
The National Herald case traces its origins to a complaint filed by former MP Subramanian Swamy, who alleged that Congress leaders misused party funds to acquire AJL through Young Indian. The National Herald newspaper, founded by Jawaharlal Nehru in 1938, had ceased publication in 2008 due to financial difficulties.

According to the allegations, the Congress party extended loans to AJL, which were later assigned to Young Indian. By acquiring these loans, Young Indian allegedly gained control over AJL’s assets. The ED claims that this process amounted to a “well‑thought‑out conspiracy” to take over AJL’s properties at a fraction of their market value.

Why the FIR Matters Now
The timing of the FIR is significant. It comes six months after the ED submitted a chargesheet naming Sonia Gandhi, Rahul Gandhi, and five others in the same case. The new FIR suggests that investigators believe additional criminality may have occurred beyond what was covered in earlier proceedings.

Rajasthan minister Rajyavardhan Rathore stated that a deeper examination of the case would reveal how shares were transferred across countries and how funds allegedly moved through complex channels before returning to India. The contrasting reactions underscore the political sensitivity of the case, especially given the stature of the accused and the historical significance of the National Herald.

The FIR highlights several financial transactions that investigators believe were irregular. One key allegation involves Dotex Merchandise Pvt. Ltd., which reportedly provided a loan to Young Indian. The ED has also alleged that Young Indian is beneficially owned by Sonia and Rahul Gandhi, giving them effective control over AJL’s assets once the takeover was complete.
